Welcome to Queer Trans Marketplace (“QT Marketplace” “Marketplace,” “we,” “our,” “us”). By using our platform to browse, purchase products, and interact with vendors, you (“Customer,” “you,” “your”) agree to comply with the following Customer Terms of Service (TOS). Please read these terms carefully before making a purchase. 

1. Customer Eligibility & Account Registration 

1.1. You must be at least 18 years old to make purchases on our platform.  

1.2. Customers are responsible for providing accurate information, including shipping details and payment information.  

1.3. You agree to keep your account secure and are responsible for any activity that occurs under your account. 

2. Purchasing on the Marketplace 

2.1. Product Listings & Availability 

  • Vendors manage their own listings and are responsible for providing accurate descriptions, pricing, and images. 
  • We do not guarantee the availability of any product listed on the Marketplace. 

2.2. Order Fulfillment & Shipping 

  • Vendors are expected to ship products within one week unless otherwise specified in their store policies. 
  • Shipping rates and methods are determined by each vendor. Customers should review vendor-specific shipping policies before purchase. 
  • The Marketplace is not responsible for lost, delayed, or damaged shipments. Any disputes should be resolved directly with the vendor. 

2.3. Returns & Refunds 

  • Each vendor sets their own return and refund policies. Customers should review vendor policies before purchasing. 
  • If a vendor does not offer returns, the Marketplace is not responsible for issuing refunds. 
  • Customers must contact vendors directly to initiate returns or request refunds. 

3. Payments & Fees 

3.1. Payments are processed securely through third-party payment providers (e.g., Stripe, PayPal). Saved payment information is stored with third-party payment providers for added security.  

3.2. Customers are responsible for ensuring their payment information is accurate and up to date.  

3.3. The Marketplace does not charge customers additional fees beyond the listed product price and applicable shipping costs. 

4. Customer Responsibilities & Conduct 

4.1. Respectful Engagement 

  • Customers agree to interact respectfully with vendors and other users. 
  • Harassment, discrimination, or abusive behavior will not be tolerated and may result in account suspension. 

4.2. Prohibited Activities 

  • Customers may not use the platform for fraudulent purchases, chargeback abuse, or other deceptive practices. Violation of these policies will result in account suspension. 
  • Customers may not attempt to circumvent vendor policies or marketplace guidelines. 

5. Disputes & Resolution 

5.1. A purchase on Queer Trans Marketplace is a transaction directly between the customer and the vendor. Customers should attempt to resolve disputes directly with vendors.  

5.2. If an issue cannot be resolved, customers may contact the Marketplace for mediation, but we do not guarantee refunds or order resolution. If a customer has not first attempted to resolve the issue directly with the vendor, we will redirect that customer’s inquiry to the vendor. 

5.3. Chargebacks or disputes filed through payment providers must align with these terms. 

6. Limitation of Liability & Indemnification 

6.1. The Marketplace acts as a platform for independent vendors and is not liable for product quality, delivery, or vendor conduct.  

6.2. Customers agree to indemnify and hold us harmless from any claims, damages, or legal actions arising from their purchases or interactions on the platform.  

6.3. We are not responsible for technical issues, downtime, or interruptions in service. 

7. Governing Law & Jurisdiction 

7.1. These terms are governed by the laws of The State of Colorado. Any disputes shall be resolved in the courts of Colorado. 

8. Privacy & Data Use 

Queer Trans Marketplace deeply values your trust and your privacy. We are committed to protecting the personal information you share with us when using our site. 

8.1. No Selling of Personal Data. We will never sell, rent, or share your personal data with third parties for marketing or advertising purposes. Period. 

8.2. Internal Data Use. We may collect and store certain information about your activity on the site — such as your browsing behavior, purchase history, and interaction with vendors — to help us: 

  • Improve your overall experience on Queer Trans Marketplace 
  • Recommend products, vendors, and offerings you may enjoy 
  • Inform you about sales, promotions, or events that align with your interests 

This data is used exclusively by Queer Trans Marketplace and is handled with care and intention. Any data collected is stored securely and used in accordance with best practices for privacy and digital safety. 

8.3. Cookies and Tracking Technologies. Like many websites, we may use cookies and similar tracking technologies to enhance your experience (e.g., keeping items in your cart, remembering your preferences). You can control cookie settings through your browser, and using the site implies consent to these practices unless settings are adjusted. 

8.4. Your Rights and Choices. You have the right to access, update, or delete your personal information at any time. If you have questions or requests about how your data is used, you can always contact us at autumn@queertransmarketplace.com.

Welcome to Queer Trans Marketplace (“QT Marketplace,” “Marketplace,” “we,” “our,” “us”). By registering as a vendor and using our platform to sell goods and services, you (“Vendor,” “you,” “your”) agree to comply with the following Vendor Terms of Service (TOS). Please read these terms carefully before listing products on our platform. 

1. Vendor Eligibility & Registration 

1.1. Who Can Be a Vendor? Queer Trans Marketplace exists to help LGBTQ+ small business owners build their livelihoods. We ask that all vendors respect this mission. However, you are the best judge of whether we are an appropriate marketplace for you. You know yourself the best, and you don’t need to prove or justify your work here to us or anyone else. Before assuming that a vendor doesn’t belong on QT Marketplace due to their identity, we ask all vendors and users to remember that not all LGBTQ+ people can or want to be out – and that’s okay. 

1.2. You must be at least 18 years old and legally able to enter into contracts.  

1.3. You must provide accurate business information, including your legal name, contact details, and tax identification number (if applicable).  

1.4. You are responsible for ensuring your account security and for any activity that occurs under your account. 

2. Listing & Selling on the Marketplace 

2.1. What Can I Sell? 

  • No listing or selling weapons, food, medications, drugs, alcohol, or adult content – it’s a legal thing. We aren’t licensed to sell or distribute these things through our platform. 
  • No listing or selling products that include hate speech – This includes products that use terms commonly recognized as slurs against protected populations and products encouraging or inciting discrimination or violence against protected groups. 
  • No selling others’ intellectual property – Artists and artisans work hard to create amazing work! We have a strict policy against selling work that is stolen from another artist. This includes items made using AI that was trained on unlicensed work. While the use of AI for generating ideas or checking work is acceptable, we insist that you do not infringe on others’ original art by selling work generated by AI. 
  • Use plant-based materials and ingredients – To limit disease transmission, encourage sustainability, and encourage a brighter future for all, we do not allow the sale of animal-based prodcuts like leather, fur, wool, or milk.
  • No animal testing – To ensure a kinder world for all who live in it, vendors who sell on Queer Trans Marketplace must commit to a strict no animal testing policy. Since Queer Trans Marketplace is for small to midsize businesses, vendors will likely not be engaged in animal testing operations by default. 

2.2. Accurate Listings: Product descriptions, pricing, and images must be truthful and not misleading.  

When listing a new product, you must name, describe, and tag products accurately. Customers expect to receive the product they order, and if listings are inaccurate, customers can report them. This may result in the product being taken down from the website. 

Similarly, tags must be relevant to the product. Simply adding tags that you think will be popular to get a product to show in more searches is not permitted (and will not increase your sales). A violation here may also result in your product being taken down from the website. 

2.3. Order Fulfillment: We ask that you ship within one week of receiving an order. If you are out of town, taking a break, or cannot ship within a week, you can pause your store. If you are unable to fulfill an order you receive, you must issue the customer a full refund. 

2.4. Pricing: Vendors are responsible for setting and managing their own pricing, but they must not engage in price fixing or other anti-competitive behaviors. 

3. Payments & Fees 

3.1. Vendor Fees Queer Trans Marketplace does not charge listing fees or vendor registration fees. We want our success to be intertwined with yours. That means we don’t get paid unless you do. 

When you make a sale, the following fees will be charged: 

  • Stripe, our credit card processing partner will charge you 2.9% + $0.30 for credit card processing fees. These fees are set by Stripe and may be subject to change. Queer Trans Marketplace has no control over whether Stripe chooses to raise or change prices. 
  • Queer Trans Marketplace charges 5% in exchange for bringing in new customers, maintaining and running the platform. This helps us pay our staff and keep the site up and running! It also helps us run email marketing campaigns and paid marketing campaigns on social media to help sell your products! 

3.2. Payment Processing: Transactions will be processed through Stripe Connect. Vendors must connect a valid payment account.  

3.3. Payout Schedule: Vendor earnings will be disbursed when the vendor makes a withdrawal from the vendor dashboard. You can withdraw your earnings by going to Vendor Dashboard -> Withdraw. There is no minimum threshold for withdrawals, but you can only withdraw payments from orders that have been completed for at least 14 days. This is to ensure that any disputes or refund requests can be settled before withdrawals are made. 

3.4. Chargebacks & Refunds: Vendors are responsible for handling refund requests and disputes in compliance with our Refund & Return Policy.  

4. Vendor Responsibilities 

4.1. Customer Service: Vendors must respond to customer inquiries, complaints, and disputes in a timely and professional manner.  

4.2. Returns & Refunds: Vendors must comply with our return and refund policy and clearly communicate return instructions to buyers.  

4.3. Legal & Tax Compliance: Vendors are responsible for reporting income and paying any applicable taxes. We do not provide tax advice or documentation beyond standard payment reports. Stripe, our credit card processing partner, will issue you a 1099 at the beginning of each year showing the income you received the previous year. You may use this document for tax reporting purposes. Queer Trans Marketplace does not prepare these documents, and any questions regarding errors or issues with 1099s should be directed to Stripe.  

4.4. Intellectual Property: Vendors must ensure they have the right to sell all listed products and must not infringe on trademarks, copyrights, or patents. 

5. Marketplace Policies & Enforcement 

5.1. Account Suspension & Termination: We reserve the right to suspend or terminate vendor accounts that violate these terms, engage in fraudulent activity, or receive excessive complaints.  

5.2. Dispute Resolution: Vendors agree to work with us in good faith to resolve disputes with customers and comply with our resolutions.  

5.3. Policy Updates: We may update these terms from time to time. Vendors will be notified of significant changes, and continued use of the platform constitutes agreement to the new terms. 

6. Limitation of Liability & Indemnification 

6.1. No Guarantee: While Queer Trans Marketplace agrees to make a good-faith effort to bring new traffic and customers to the platform through our chosen marketing methods, we do not guarantee sales, traffic, or business success to any specific vendor or vendors. 

6.2. Indemnification: Vendors agree to indemnify and hold us harmless from any claims, damages, or legal actions arising from their use of the marketplace, including product liability or intellectual property disputes.  

6.3. Platform Downtime: We are not liable for losses due to technical issues, maintenance, or outages. 

7. Governing Law & Jurisdiction 

7.1. These terms are governed by the laws of The United States of America. Any disputes shall be resolved in the courts of Queer Trans Marketplace’s state of Registration, Colorado.
